South Korea’s AI Basic Act Takes Effect, Sets Rules For Generative AI

South Korea’s Artificial Intelligence (AI) Basic Act took effect on Thursday, establishing rules for the use of AI, including provisions addressing deepfakes. The law requires companies to notify users in advance when products or services use generative AI and to label content, including deepfakes, which cannot be easily distinguished from reality.

Passed in December 2024, the law aims to provide a framework for AI use while supporting innovation, according to the Ministry of Science and ICT. Violations can result in fines of up to 30 million won (USD 20,400). President Lee Jae Myung noted that the act is now fully in force. South Korea said the law is part of its plan to position the country among the top three AI powers, alongside the United States and China. Media reports describe it as the first comprehensive AI regulation to take effect globally, with the European Parliament’s AI rules expected to be fully applied by 2027.
