UBS faces legal dilemma over Swiss regulatory confidentiality and US court demands
UBS is facing conflicting legal obligations after Switzerland’s financial regulator, FINMA, prohibited the bank from disclosing confidential supervisory documents to a US federal court in Manhattan, according to Global Investigations Review.
The documents are being sought in litigation connected to the collapse of Credit Suisse, which UBS acquired in 2023. FINMA has invoked supervisory privilege, arguing that disclosure could undermine regulatory confidentiality and its ability to oversee financial institutions.
UBS faces potential consequences under Swiss law if it releases the protected documents, while non-compliance with the US court’s demands could expose it to legal repercussions in the American proceedings.
The dispute highlights the challenges multinational financial institutions face when navigating conflicting regulatory requirements across jurisdictions. It also raises important questions about supervisory confidentiality, cross-border legal cooperation and the protection of regulatory information.
