X Moves EU Court Against 120 Million Euro Digital Services Act Penalty

Elon Musk-owned X has approached the European Union’s General Court to contest a 120 million euro penalty imposed under the bloc’s digital content framework.

X said it has filed an appeal before the General Court of the European Union challenging the decision of the European Commission, which acts as the EU’s digital regulator. The fine was issued in December under the Digital Services Act. The Commission held that the platform failed to meet transparency requirements. It also flagged concerns over the structure of the blue checkmark system for verified accounts, and the company’s refusal to grant researchers access to certain public data. The penalty marked the first enforcement action under the DSA.

X said the investigation was flawed and argued that the regulator misread its obligations under the law. The company also maintained that due process standards were not fully observed during the proceedings. It described the appeal as the first court challenge to a fine under the DSA.
