
Germany Orders Amazon To Repay 59 Million Euros Over Marketplace Pricing Controls
The Bundeskartellamt said the amount reflects economic benefits obtained through pricing mechanisms on Amazon.de. The decision, announced on February 5, 2026, is the first use of disgorgement powers since the 2023 reform of German competition law.
The authority found that Amazon’s controls on third-party seller pricing constituted an abuse of market power under national law and Article 102 of the Treaty on the Functioning of the European Union. Andreas Mundt said influencing competitors’ pricing is permissible only in limited situations. The regulator examined tools that could remove offers or limit visibility, including exclusion from the Buy Box. It said such measures could reduce seller turnover. Amazon said it will appeal the ruling before the German Federal Court of Justice.
The case involved coordination with the European Commission and Bundesnetzagentur.
