New York Times Files Countersuit Against U.S. Agency Over DEI Employment Case

The New York Times has filed a countersuit against the U.S. Equal Employment Opportunity Commission (EEOC), alleging that the agency targeted the newspaper over its coverage of the Donald Trump administration.

The filing, submitted in a Manhattan federal court, seeks dismissal of the EEOC’s lawsuit and claims that the agency’s actions violate the newspaper’s constitutional rights related to free speech and due process. The Times denied allegations that diversity goals influenced its decision to appoint a multiracial woman instead of a white male candidate for a Deputy Editor position.

The EEOC had filed a case in May on behalf of Bryant Rousseau, who claimed he was overlooked for the role despite his qualifications. The agency alleged the decision was linked to the newspaper’s diversity initiatives.

The EEOC said it does not comment on ongoing litigation. The case is part of broader scrutiny of workplace diversity policies in the U.S.
