FTC Alleges PepsiCo Rigged Soft Drink Competition With Unequal Pricing

The Federal Trade Commission (FTC) has filed a lawsuit against PepsiCo, alleging illegal price discrimination under the Robinson-Patman Act by favouring a large retailer with promotional payments and pricing advantages while raising prices for other retailers

The FTC claims this practice has disadvantaged smaller competitors and led to higher costs for consumers, violating the Robinson-Patman Act. FTC Chair Lina M. Khan stated the lawsuit aims to ensure fairness for all businesses, regardless of size. The FTC is seeking to lift redactions on certain alleged violations related to Pepsi’s practices. PepsiCo has yet to comment on the lawsuit.
